Welcome to Brent’s Pistols. By accessing our website, purchasing products, or using our services, you agree to be bound by the following Terms & Conditions. Please read them carefully before completing any transaction.
1. Compliance with Federal, State, and Local Laws
Legal Age Requirements: You must be at least 21 years of age to purchase handguns, stripped receivers, frame assemblies, or handgun ammunition from Brent’s Pistols.
State & Local Restrictions: Firearms and restricted items will not be shipped to jurisdictions where they are prohibited by law. It is the buyer’s sole responsibility to ensure that any item ordered is legal in their state, county, and municipality before placing an order.
Prohibited Persons: By placing an order, you certify under penalty of perjury that you are legally permitted to purchase and possess firearms under 18 U.S.C. § 922(g) and applicable state laws.
2. Firearms Shipping & FFL Transfer Policy
FFL Transfer Requirement: In compliance with federal law, all firearms sold by Brent’s Pistols must be shipped directly to a licensed Federal Firearms License (FFL) holder. We do not ship firearms directly to individual consumers.
Selecting an FFL: During checkout, you must select or provide a valid local FFL dealer to receive your transfer. You must contact your chosen FFL dealer prior to placing your order to confirm they will accept the transfer.
Background Checks & Fees: The receiving FFL dealer will conduct the required ATF Form 4473 background check before releasing the firearm to you. Transfer fees charged by your local FFL are independent of Brent’s Pistols and are your responsibility.
Failed Background Checks: If you fail the background check or are otherwise unable to take possession of the firearm at your FFL dealer, you are subject to a 15% restocking fee, plus the cost of return shipping.
3. Magazine Capacity & State Restrictions
High-Capacity Magazine Restrictions: Orders containing magazines that exceed local state capacity limits (e.g., California, New York, New Jersey, Massachusetts, Washington) will have those items removed, substituted, or canceled.
No Modification Service: We do not block, pin, or alter magazines to meet local legal compliance. Restricted items will simply be removed prior to shipment.
4. Ammunition Sales Policy
Age & Compliance Verification: Ammunition buyers must be 21 years of age or older. Orders originating from states requiring state-issued permits (e.g., Illinois FOID) or background checks (e.g., California, New York) must submit proper documentation prior to fulfillment.
All Ammunition Sales Final: Due to safety regulations, all sales of ammunition are final. We do not accept returns or exchanges on ammunition once it leaves our facility.
5. Orders, Pricing, and Refusal of Service
Order Verification: All orders are subject to acceptance, inventory verification, and security review. Brent’s Pistols reserves the right to cancel or refuse any order at any time for any reason.
Pricing & Typographical Errors: In the event of a pricing error or incorrect product specification, Brent’s Pistols reserves the right to cancel any orders placed for the affected item.
Straw Purchases: We strictly enforce zero tolerance for illegal straw purchases (purchasing a firearm on behalf of another individual who is prohibited or not the actual buyer). Any suspected straw purchases will be canceled immediately and reported to law enforcement.
6. Pre-Orders & Backorders
Payment Authorization: Pre-orders and backorders are billed at the time the order is placed to reserve your allocation.
Cancellation Policy: Pre-orders may be canceled for a full refund prior to shipping, provided the item has not been packed or processed for transit.
7. Shipping, Delivery, & Lost Packages
Shipping Restrictions: Firearms and ammunition ship separately in accordance with carrier regulations.
Adult Signature Required: All firearm shipments require an adult signature upon delivery to your designated FFL dealer.
Carrier Liability & Insurance: Once a package is scanned into transit by the carrier (USPS, FedEx, or UPS), risk of loss passes to the buyer or carrier. Optional shipping insurance is available at checkout for lost, stolen, or damaged packages in transit.
8. Inspection, Returns, & Restocking
Firearm Inspection Policy: You must thoroughly inspect your firearm at your FFL dealer before completing the ATF Form 4473 background check and taking possession. Once the firearm is transferred into your name, it is considered used and cannot be returned to Brent’s Pistols.
Non-Firearm Returns: Unused, unopened non-firearm accessories, optics, and gear may be returned within 30 days of delivery for a refund or store credit, subject to inspection and a 15% restocking fee. Return shipping costs are the responsibility of the customer unless the return is due to our fulfillment error.
9. Limitation of Liability & Warranty Disclaimer
As-Is & Manufacturer Warranties: All factory-new products carry respective manufacturer warranties. Brent’s Pistols disclaims all express or implied warranties beyond standard manufacturer coverage.
Safe Use & Hold Harmless: Brent’s Pistols assumes no liability for damages, injuries, or legal actions resulting from the improper handling, misuse, unauthorized modification, or illegal possession of firearms, ammunition, or accessories purchased from our store.
10. Privacy & Data Security
Information Collection: We collect customer information strictly to process orders, fulfill FFL compliance obligations, and maintain sales records as required by federal law.
Data Handling: Customer data is never sold to third-party marketers. Payment processing is fully PCI-DSS compliant and encrypted.
11. Governing Law & Dispute Resolution
Jurisdiction: These Terms & Conditions are governed by and construed in accordance with the laws of the State of incorporation, without regard to conflict of law principles.
Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the purchase of products from Brent’s Pistols shall be resolved through binding arbitration rather than in court, and you waive any right to participate in class-action lawsuits.
12. Intellectual Property & Modifications
Content Ownership: All text, imagery, graphics, logos, software, and brand assets on this site are the exclusive property of Brent’s Pistols.
Terms Updates: Brent’s Pistols reserves the right to update or modify these Terms & Conditions at any time without prior notice. Your continued use of the website following any changes constitutes full acceptance of those updates.
